Canon Environmental Web Tool Terms and Conditions & Privacy Policy

PLEASE READ THIS DOCUMENT CAREFULLY BEFORE USING THE CANON ENVIRONMENTAL WEB TOOL. BY USING THE CANON ENVIRONMENTAL WEB TOOL YOU ARE AGREEING TO THESE TERMS AND CONDITIONS.

1. Acceptance

1.1. Canon Europe ("Canon") provides the Canon Environmental Web Tool to you on the basis of the following terms and conditions ("Terms and Conditions"). You agree to be bound by these Terms and Conditions each time you access and/or use the Canon Environmental Web Tool.

2. Use

2.1. The Canon Environmental Web Tool is provided to you at no charge and is for personal use.

2.2. You undertake not to input into the Canon Environmental Web Tool any materials that are or could reasonably be construed as: (i) false; (ii) defamatory, libellous, obscene, offensive, abusive, liable to incite racial hatred, discriminatory or blasphemous; (iii) in breach of any obligation of confidence or privacy or any trade secret; (iv) infringing the proprietary rights of any third party or for which you have not obtained all necessary licences and/or approvals; or (v) violating any other law.

2.3. You also agree not to transmit to or input into the Canon Environmental Web Tool any materials which could reasonably be held to constitute or encourage conduct that would be considered a criminal offence, give rise to civil liability, or otherwise be contrary to the law of any country or other competent authority, or infringe the rights of any third party enforceable in any part of the world.

2.4. You agree to indemnify Canon and Canon affiliates against any claim, demand, loss or damage suffered as a result of breach of this Section 2.

3. Your personal data

3.1. The use that Canon shall make of your personal information shall be in accordance with Canon's privacy policy further described in Section 4 and limited to the purpose described when you give your permission for such use. 

3.2. When you input personal data into the Canon Environmental Web Tool, you agree to provide Canon with accurate data as requested in the online form. For details of our use and transfer of your personal data, please refer to the PRIVACY POLICY below.

4. PRIVACY POLICY

4.1. Any personal information supplied by you via the Canon Environmental Web Tool, or by any e-mail correspondence will be used by Canon, which for the purposes of this Section 4 will also include other companies of the Canon Group of companies in Europe, for the purpose of providing the services that you have requested. You further authorise Canon and other companies of the Canon Group to use such data for the following purposes:

(i)      You consent to Canon and companies of the Canon Group contacting you via regular mail, email, telephone or fax. 

(ii)    You permit Canon to collect and use all of the information submitted in this application for marketing purposes or to inform you about other products and services. 

4.2. From time to time Canon or other companies of the Canon Group of companies in Europe might use this personal information for marketing purposes or to inform you about other products and services, which we think might be of interest for you.

4.3. Your personal information might be passed on to other companies of the Canon Group of companies in Europe for the purposes set out above and for the purposes of group administration and to provide related websites or information to you. Canon will endeavour to ensure that necessary measures are in place to protect the confidentiality and security of your information.

4.4. We are committed to protecting your privacy. Your personal data is held on secure computer and manual files and shall not be processed for any other purpose than those set out in this Privacy Policy. The server Canon uses to store this information is accessible to authorised staff only, is connected to the Internet through a firewall and is therefore not accessible to the public. If a third party server is used, the same security measures shall be in place.

4.5. Small pieces of information known as cookies may be saved on your computer to store a number that enables the system to identify your current connection to the Canon Environmental Web Tool. The cookie will not store any personal data and cannot read data off your hard disk. You can choose not to accept a cookie by enabling your web browser to refuse cookies or to prompt you before accepting one. Please be aware that, by not accepting cookies, we may not be able to offer you the services.

4.6. If you wish us to delete your data, you need to submit an email to Daniel.Seris@canon-europe.com.

4.7. If you have entered information on the Canon Environmental Web Tool, we will hold your personal information for the duration necessary for the purposes for which you have allowed us to use your data.

5. Disclaimer

5.1. You agree not to place any reliance on the results generated by the Canon Environmental Web Tool which are by their very nature approximate and illustrative only. Canon disclaims all liability for any reliance that you place on the Canon Environmental Web Tool. You rely upon the Canon Environmental Web Tool at your own risk. 

5.2. Canon hereby excludes, to the maximum extent permitted by law, all conditions, warranties, representations or other terms concerning the supply or purported supply of, failure to supply or delay in supplying any service in connection with the Canon Environmental Web Tool or that the results provided by the Canon Environmental Web Tool, are accurate, complete or up-to-date, which might but for this Section 5 have effect between Canon and you, or would otherwise be implied into or incorporated into these Terms and Conditions or any collateral contract, whether by statute, common law or otherwise. 

5.3. You understand and agree that you are using the Canon Environmental Web Tool at your sole risk and that Canon does not warrant that the Canon Environmental Web Tool will meet your requirements or that the Canon Environmental Web Tool will be uninterrupted or error free. Any content or services provided via or in connection with the Canon Environmental Web Tool by Canon is done so on an "AS IS" and on an "AS AVAILABLE" basis and Canon makes no representations or endorsement of any kind, whether express or implied, with respect to the Canon Environmental Web Tool for the content or services included in, or made available in connection with, the Canon Environmental Web Tool. Canon reserves the right at its sole discretion, to amend or withdraw the Canon Environmental Web Tool.

6. Liability

6.1. Canon and any of Canon's group companies and the officers, directors, employees, shareholders or agents of any of them, exclude, to the maximum extent permitted by law, all liability and responsibility for any amount or kind of loss or damage that may result to you or a third party, (including without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages) arising from or connected in any way to business interruption, and whether in tort (including without limitation negligence), contract or otherwise in connection with the Canon Environmental Web Tool in any way or in connection with the use, inability to use or the results of use of the Canon Environmental Web Tool, including but not limited to loss or damage due to viruses that may infect your computer equipment, software, data or other property on account of your access to, use of, or browsing the Canon Environmental Web Tool or your downloading of any material from the Canon Environmental Web Tool or any websites linked to the Canon Environmental Web Tool. This shall not affect your statutory rights.

6.2. Nothing in these Terms and Conditions shall exclude or limit Canon's liability for: (i) death or personal injury caused by its negligence; (ii) fraud; or (iii) any liability which canot be excluded or limited under applicable law.

7. Miscellaneous

7.1. The construction, validity and performance of these Terms and Conditions shall be governed by UK law and Canon and you agree to submit to the non-exclusive jurisdiction of the [insert] courts.

7.2. A failure of Canon to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision and shall in no way affect its right to later enforce or exercise it.

7.3. If any provision of these Terms and Conditions is found by a court of competent jurisdiction to be invalid, the parties agree that it shall not affect the validity or enforceability of any other terms or rights which shall continue in full force and effect except for any such invalid or unenforceable provision or part thereof.
